On 5 April 2023, the European Commission published:
  1. A draft Delegated Act that defines the technical screening criteria of the four other environmental objectives of the Taxonomy Regulation (‘Environmental Delegated Act’), namely:
    • sustainable use and protection of water and marine resources,
    • transition to a circular economy,
    • pollution prevention and control, and,
    • protection and restoration of biodiversity and ecosystems.
The Environmental Delegated Act includes proposed changes to the Disclosures Delegated Act, including the content of the mandatory reporting templates.
  1. A draft Delegated Act to amend the Climate Delegated Act, covering the climate-related environmental objectives of climate change mitigation and climate change adaptation.

The European Commission has also launched new Taxonomy tools:
  • a Taxonomy Navigator;
  • a Taxonomy Calculator; and
  • an FAQ repository.

What are the next steps?
Draft Delegated Acts are open for public consultation for four weeks from 5 April 2023 until 3 May 2023.
(the consultation documents can be found here).
The final texts are expected in June 2023.
After the adoption of the Delegated Acts by the European Commission, they are subject to a scrutiny period of at least two months where the European Parliament and the EU Council can raise objections to the texts. If no objection is raised, the Delegated Acts come into force after their publication in the Official Journal of the European Union. They are then applicable from 1 January 2024 onwards.
Reminders
What is the difference between eligibility and alignment?
An economic activity is Taxonomy-eligible if it fits the description of an activity detailed in the Delegated Acts supplementing the Taxonomy Regulation – that is, the Climate Delegated Act and, henceforth, the draft Environmental Delegated Act on the four other objectives.
An economic activity is Taxonomy-aligned where the activity is eligible and complies with all of the following: 
  • the substantial contribution criteria;
  • the do no significant harm (DNSH) criteria; and
  • the minimum safeguards (MS).

Undertakings in the scope of CSRD
The scope of the Taxonomy Regulation will be extended from 2025 for 2024 reporting, when the CSRD comes into force.
In most cases, companies that are within the scope of the CSRD will have to disclose Taxonomy information in their sustainability statements.
